Welcome to Bisadaya!

We (“Bisadaya”, “PT Bisadaya Sejahtera Berkarya” or “We/Us/Our”) are a job portal service provider that facilitates the relationship between job seeker (“Seeker”) and company (“Employer”) operated by PT Bisadaya Sejahtera Berkarya, under Fast8 People Hub, a company incorporated under the laws of the Republic of Indonesia with its registered office in Jakarta.

By registering, using, or accessing the Bisadaya Platform, you agree to comply with these Terms and Conditions (T&C Bisadaya). These Terms and Conditions constitute a legally binding agreement between You and Us. If you do not agree to be bound by these Terms, you may not use our services.

We have the right to update these T&C Bisadaya from time to time. You are responsible for reviewing these T&C Bisadaya periodically. By continuing to use our services, you agree to these changes.

In addition to these Terms and Conditions, you must read and agree to our Privacy Policy, which explains how we handle your personal information.

  1. DEFINITION

    Bisadaya Platform refers to the job portal operated by Bisadaya or PT Bisadaya Sejahtera Berkarya, encompassing the website, mobile applications, and other services provided to job seekers and employers, under the name/domain designated by Bisadaya from time to time.

    Fast8 People Hub or PT Fatiha Sakti refers the parent company that oversees the operation of digital platforms such as Bisadaya, Gadjian, Hadirr, Baktiku, Payuung, and Pegawe.

    User refers any individual or entity that accesses and/or uses the Bisadaya Platform, including but not limited to those registered as Employers or Seekers, or those who are not registered but still utilize the services or content available on the Bisadaya Platform.

    Seeker or You refers an individual job seeker who has registered an account on the Bisadaya Platform.

    Employer refers a verified company that provides job vacancy information on the Bisadaya Platform.

    Calendar Day refers to every day of the year according to the Gregorian calendar, without exception, including Saturdays, Sundays, national holidays designated by the government from time to time, and working days that, due to specific circumstances, are declared non-working days by the government.

    Working Day refers to any day other than Saturdays, Sundays, public holidays, national holidays in the Republic of Indonesia, and any other day on which general banks in Indonesia are closed and do not operate.

  2. REGISTRATION AND ACCOUNT MANAGEMENT

    1. To register as an Employer, you must go through and complete the following process:

      1. Create an Account: Visit our website at www.bisadaya.com, click on REGISTER and complete the required data.
      2. Agreement:: You read, understand and agree to S&K Bisadaya Terms and Conditions and other related policies or guidelines provided by Bisadaya.
      3. Account Activation: Bisadaya will send a message to the registered email for each successful account creation request, and You will be directed to activate your account.
      4. Complete Profile: If the account activation is successful, you will be directed to complete your Profile with your desired job preferences, educational background, and most recent work experience. This allows us to recommend jobs that are a good fit for you.
      5. Apply Job: You can now use our service to apply for jobs.
    2. You are responsible for the authenticity and accuracy of the data and information provided and displayed on Bisadaya.

    3. As a Bisadaya Account User, You understand and agree to the following benefits:

      1. Cross-Platform Access : As part of the Fast8 People Hub, your Bisadaya account can be integrated with other platforms operated by Fast8 People Hub. This integration allows you to use the same login credentials on multiple Fast8 People Hub platforms without having to create separate accounts for each platform.
      2. Connected Services: You can enjoy seamless access and interaction between the Bisadaya Platform and the following Fast8 People Hub platforms: 1) Gadjian, 2) Hadirr, 3) Baktiku, and 4) Payuung Pribadi. The list of connected services may be expanded or changed over time. Any changes will be communicated to you through available information channels.
      3. Data Integration: By using Bisadaya and agree T&C Bisadaya, You consent to sharing and integrating your account information with the services listed in subsection b above. This information, including your profile, job vacancies, and other relevant data, will be used to enhance your experience on the Fast8 People Hub platforms.
  3. BISADAYA RESPONSIBILITY

    1. Bisadaya undertakes the responsibility of providing a stable and dependable platform for all Users, enabling Employers and Seekers to facilitate connections for suitable candidates for advertised job vacancies. Bisadaya is dedicated to offering technical support to maintain the seamless operation of the Bisadaya Platform. This encompasses troubleshooting technical difficulties, conducting regular maintenance, and executing updates.

    2. Bisadaya maintains the confidentiality of data received from Users and will not disclose such data to third parties without the written consent of the disclosing party. Bisadaya will only use the obtained data for purposes permitted under these T&C Bisadaya.

      The obligation of data confidentiality shall not apply to information that:

      1. Is already public knowledge or is known to the public without a breach of confidentiality obligations.
      2. Was known to Bisadaya prior to receiving it from the user.
      3. Is disclosed pursuant to a court order or a competent government authority, provided that Bisadaya shall promptly notify the user of such disclosure.
    3. Bisadaya is responsible for ensuring that all platform operations comply with applicable laws and regulations. We conduct regular monitoring of Bisadaya Platform Users to ensure compliance with legal standards, Bisadaya policies, and platform security. Bisadaya has the authority to take necessary actions, including but not limited to, restricting access, terminating services, or taking other legal actions if any violations or risks are detected that may disrupt the quality and security of the Bisadaya Platform.

  4. SEEKER RESPONSIBILITY

    1. Bisadaya is committed to providing a safe, professional, and inclusive platform. You are responsible for complying with all applicable laws and regulations, including but not limited to labour laws, data privacy laws, anti-slavery, anti-human trafficking, and prohibitions against organized crime.

    2. To protect and ensure the appropriate use of Bisadaya Platform, the following activities are prohibited for Users:

      1. Fake Information

        You are prohibited from uploading or publishing any inaccurate or misleading information in job postings.

      2. Illegal Use

        You are prohibited from using the Bisadaya Platform for any unlawful purpose, including but not limited to spamming, fraud, or any other illegal activity.

      3. Harassment and Discrimination

        You are prohibited from engaging in any form of harassment or discrimination against other Users. The Bisadaya Platform is inclusive of all races, genders, religions, or other characteristics.

  5. INTELLECTUAL PROPERTY

    Both Parties acknowledge and agree that these T&C Bisadaya do not transfer any Intellectual Property Rights ("IPR") from one Party to the other. All rights and titles shall remain with the Party owning the IPR, and the other Party shall not copy, modify, or create derivative works from any IPR without the prior written consent of the Party owning the IPR.

  6. TERMINATION AND SUSPENSION ACCOUNT

    Both Parties acknowledge and agree that these T&C Bisadaya do not transfer any Intellectual Property Rights ("IPR") from one Party to the other. All rights and titles shall remain with the Party owning the IPR, and the other Party shall not copy, modify, or create derivative works from any IPR without the prior written consent of the Party owning the IPR.

    1. By Seeker

      You may terminate your use of the Bisadaya service at any time by providing written notice to the Contact Information specified in Article 10 of T&C Bisadaya. All data associated with your account will be deleted in accordance with our Privacy Policy. Fees already paid by you are non-refundable.

    2. By Bisadaya

      Bisadaya has the right to suspend or terminate your account at any time if any of the following events occur:

      1. In the event that you are found to have breached these T&C Bisadaya, including without limitation, violations of law, misuse of the service, or actions that cause harm to other users.
      2. In the event that you fail to comply with any applicable laws or regulations, such as those related to labour laws, data protection, anti-slavery, anti-human trafficking, and prohibition of criminal organizations.
      3. In the event of a request or order from a competent legal authority to suspend or terminate services provided to You.
  7. DISCLAIMER AND LIMITED LIABILITY

    1. Bisadaya does not guarantee the outcome or success of the recruitment or job search process through the Bisadaya Platform. All decisions regarding hiring, placement, or job suitability are the sole responsibility of the parties involved.
    2. Bisadaya is not responsible for the content uploaded to the Bisadaya Platform. You are solely responsible for the accuracy, validity, and compliance of such content with applicable laws.
    3. Bisadaya is not liable for any losses that may arise from the use of the platform, including data loss or loss of business opportunities.
  8. DISPUTE RESOLUTION

    1. This T&C Bisadaya is governed by and construed in accordance with the laws of the Republic of Indonesia.
    2. Any dispute or disagreement arising from or in connection with these T&C Bisadaya, the Parties shall first endeavour to resolve such dispute through good faith negotiations within 30 (thirty) Business Days.
    3. If the dispute or disagreement cannot be resolved within such period, then the dispute shall be settled through Pengadilan Negeri Jakarta Selatan.
  9. MISCELLANEOUS

    1. T&C Bisadaya, along with any other policies or guidelines referenced herein, constitute the entire agreement between you and Bisadaya regarding the use of the Bisadaya Platform.
    2. Bisadaya has the right to modify these T&C Bisadaya any time. Any changes will be effective upon posting of the revised T&C Bisadaya on the Bisadaya Platform. You are responsible for regularly reviewing these T&C Bisadaya. Your continued use of the Bisadaya Platform following the posting of changes constitutes your acceptance of such changes.
    3. If any provision of these T&C Bisadaya is held to be invalid, illegal, or unenforceable for any reason, such provision shall be deemed severed from these T&C Bisadaya and shall not affect the validity and enforceability of the remaining provisions.
    4. You may not assign your rights or obligations under these T&C Bisadaya without Bisadaya's prior written consent. Bisadaya may assign its rights and obligations under these Bisadaya Terms and Conditions at any time without notice to you.
    5. Nothing inT&C Bisadaya shall be construed as creating any partnership, joint venture, agency, or employment relationship between you and the Bisadaya Platform. You are an independent contractor and are solely responsible for your own actions.
